Divorce and Separation

Divorce and separation are legal processes that allow couples to live apart, but they have distinct differences.
- Divorce: This is the legal termination of a marriage. Once a divorce is finalized, both individuals are free to remarry. Divorce involves decisions about asset division, child custody, alimony, and other financial matters.
- Legal Separation: Unlike divorce, legal separation allows spouses to live apart while remaining legally married. Some couples choose this option for religious, financial, or personal reasons. Legal separation can include agreements on property division, child custody, and spousal support, similar to divorce, but without dissolving the marriage.
In Illinois, for example, legal separation allows spouses to retain certain benefits, such as healthcare coverage, while still living separately. However, financial responsibilities may still be shared, and decisions regarding children must be made jointly.
